CaribSell1 Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of CaribSell1's website, mobile application, and related services (the "Services") provided by Xen Life Journey, LLC ("CaribSell1," "we," or "us"). By accessing or using our Services, you agree to be bound by these Terms, including the mandatory arbitration provisions in Sections 21 and 22.

IMPORTANT: PLEASE READ CAREFULLY — These Terms include a binding arbitration clause that affects your legal rights. You agree to resolve disputes individually through arbitration, and not through court or class actions.

2. Scope & Agreement

By using CaribSell1, you accept these Terms and any incorporated policies. If you do not agree, do not use our Services. Additional terms may apply (e.g., from payment providers) and prevail in case of conflicts.

3. Modifications

We may update these Terms at any time at our sole discretion. Notice may be provided via email, in-app alerts, or by updating the date above. Continued use of the Services after updates constitutes acceptance. Updates may apply retroactively.

4. Eligibility

You must be at least 16 years old to use CaribSell1. Users under 18 (or local age of majority) must use the Services under parental supervision.
Businesses must comply with Caribbean corporate laws.
Users who have been previously suspended or who have violated any policies are prohibited.

Third-Party Use: If you access CaribSell1 on behalf of another entity:

“You” includes both the user and the represented entity.
You confirm authority to bind the entity.
Both parties are jointly liable for any violations.

5. Account Security

You must provide accurate information and safeguard your login credentials. Accounts are currently limited to Caribbean residents. We reserve the right to reclaim usernames.

6. Services Overview

Buying & Selling: List items for free or choose premium placement for a fee. Offline payments (cash, transfer) or CaribSell1 Payment Solutions are supported. We are not responsible for any third-party payment methods.
Jobs: Individuals and businesses may post jobs. All postings must comply with local employment laws.
Shipping: CaribSell1 does not offer shipping. Buyers and sellers are responsible for all shipping logistics and assume associated risks.

7. Payments & Taxes

CaribSell1 Payment Solution: Facilitated by third-party providers (e.g., Stripe). Usage constitutes agreement with the provider’s terms (e.g., Stripe Services Agreement).

Paid Services:

Enhanced Listings
Subscriptions: Auto-renew monthly/yearly unless canceled.
One-Time Services: Charged once, with optional repurchase.
Promotional Visibility
Premium Features
Job Postings: Subject to fees determined by CaribSell1 and local factors.

No Refunds: All paid services are final. CaribSell1 may remove any listing at its discretion without issuing refunds.

Taxes: CaribSell1 does not collect sales taxes. Users are responsible for local tax compliance.

Note: CaribSell1 is not a party to transactions conducted outside the platform and cannot mediate refunds or disputes for such transactions.

8. Prohibited Items & Conduct

Prohibited Items: Illegal goods, counterfeit products, restricted cultural artifacts, and regulated items per Caribbean laws.
User Conduct: No harassment, fraud, impersonation, or spamming. Respect local laws and intellectual property rights.

9. Verify Feature

CaribSell1’s Verify Badge improves transparency but does not guarantee:

True identity of users
Authenticity of documents
Background checks

It only confirms completion of CaribSell1's verification steps. Proceed at your own risk.

10. Disputes & Liability

Community Resolution: Try to resolve disputes directly.
Limited Role: CaribSell1 does not guarantee transaction success and assumes no liability.

11. Arbitration & Governing Law

Arbitration: Disputes are resolved individually through binding arbitration under regional arbitration bodies.
Governing Law: Your use is subject to local Caribbean jurisdiction and law, excluding conflict-of-law rules.

12. Privacy & Data

We process your data per Caribbean privacy frameworks (e.g., adaptations of GDPR). Third-party services may have separate privacy terms.

13. Cultural & Regional Adjustments

Local Laws: Compliance with national regulations (e.g., Jamaica’s Consumer Protection Act).
Meetups: Use public, safe locations. CaribSell1 does not monitor these meetups.

15. Disclaimers

Use of CaribSell1 is at your own risk. The Services are provided "as is," with no guarantees of accuracy, availability, or protection from malware. We disclaim all warranties to the fullest extent permitted under Caribbean law.

16. Limitation of Liability

CaribSell1 is not liable for indirect, incidental, or consequential damages. Exceptions apply only in cases of gross negligence or intentional misconduct under applicable law.

17. Assumption of Risk

Meetups: Exercise caution when meeting others. Use community-safe locations.
Transactions: Independently verify legitimacy. We do not conduct comprehensive user checks.

18. Release of Claims

You release CaribSell1 from liability related to:

Other users
Third-party services
Job listings

This includes waivers under regional statutes like Barbados’s Contributory Negligence Act.

19. Data Processing

Your data may be stored or processed internationally, subject to laws like Trinidad and Tobago’s Data Protection Act and Jamaica’s Data Protection Act.

20. Law Enforcement Cooperation

Requests from Caribbean law enforcement may be directed to: info@caribsell1.com.

21. Dispute Resolution & Arbitration

Binding Arbitration: Disputes are resolved individually via Caribbean Arbitration Association or a similar forum.
Opt-Out Option: Email support@caribsell1.com within 30 days of accepting the Terms with “Arbitration Opt-Out” as the subject.

22. User Content & Permissions

License Grant: You retain ownership of your content but grant CaribSell1 a non-exclusive, royalty-free, global license to use, display, and adapt it across all platforms.

Prohibited Content Includes:

Illegal, offensive, or fraudulent material
Intellectual property violations
Malware or spam
Private or sensitive third-party data

Your Responsibilities:

You have all the necessary rights to post content.
Your content complies with these Terms.

Third-Party Sharing: Content may be shared with vendors (e.g., payment processors, verification services).

Moderation: CaribSell1 may monitor and remove content at any time but assumes no responsibility to do so.

23. Service Modifications

We reserve the right to modify, suspend, or discontinue Services at any time. Users are responsible for backing up important data.

24. General Provisions

Severability: Invalid provisions will not affect the rest of the Terms.
Waiver: Failure to enforce a right is not a waiver of enforcement.
No Third-Party Rights: These Terms apply only to CaribSell1 and users.
